Terms and Conditions — YaniPay Services
These Terms of Service ("Terms" or "TOS") govern access to and use of the services offered by YaniPay SAS("YaniPay", "we", "us" or "our") via its website, mobile application, and platforms ("Services").
Any use of the Services implies unconditional acceptance of these Terms by the user ("you" or "User").

Important
By creating an account or using our Services, you acknowledge that you have read, understood and accepted these Terms in their entirety. If you do not accept these terms, please do not use our Services.
"Account"
Secure personal space created by the User to access the Services.
"Banking Services"
Payment services, money transfers, account management and bank card.
"Loyalty Services"
Loyalty programme, cashback, rewards and partner benefits.
"Identity Services"
Identity verification (KYC), strong authentication and account protection.
"YANICoin" / "YANI"
Native digital token of the YaniPay ecosystem used for rewards and services.
"UNIK Card"
Physical or virtual payment card issued by YaniPay or its partners.
YaniPay offers a full range of digital financial services:
Service availability
Certain services may not be available in all regions or for all types of users. Payment services are provided in partnership with authorised institutions. Services are currently in beta — some features may be limited.
Access to the Services requires account creation and identity verification in accordance with anti-money laundering regulations.
Prohibited uses
Applicable fees are detailed in our pricing schedule available on our website. Key fees:
Fees may be modified with 2 months' notice. You will be notified by email of any change and may close your account without charge if you do not accept the new fees.
By using the Services, you agree to:
Accuracy of information
Provide accurate, complete and up-to-date information. Any false statement may result in immediate account suspension.
Account security
Keep your credentials confidential. You are responsible for all use of your Account.
Lawful use
Use the Services in accordance with the law and these Terms. Any illegal activity is strictly prohibited.
Reporting
Notify us immediately of any unauthorised use of your Account or security breach.
YaniPay commits to using all reasonable means to ensure service continuity and security. Our liability shall not be engaged in cases of: force majeure, telecommunications network outages, failures of banking partners' systems, third-party fraudulent use of your credentials, or User breach of these Terms.
Limitation of liability
To the maximum extent permitted by law, YaniPay's total liability shall not exceed the fees paid by the User in the 12 months preceding the event giving rise to the claim.
All elements of the Site and Services (logos, trademarks, text, images, software, etc.) are protected by intellectual property rights.
Use of the Services does not confer any ownership rights over these elements. Any unauthorised reproduction or use is strictly prohibited.
Termination by User
You may close your Account at any time, free of charge, from your personal space or by contacting support. Termination takes effect within 30 days maximum.
Termination by YaniPay
YaniPay may close your Account with 2 months' notice, except in cases of serious breach (fraud, illegal activity) where termination may be immediate.
YaniPay reserves the right to modify these Terms at any time. You will be notified of any material change by email and/or in-app notification at least 2 months before it takes effect. Continued use of the Services after the change takes effect constitutes acceptance. You may close your Account without charge if you do not accept the new Terms.

EU Online Dispute Resolution (ODR)
These Terms are governed by French law. In case of unresolved dispute, the competent courts of Saint-Denis de La Réunion shall have exclusive jurisdiction, subject to any mandatory statutory provisions to the contrary.
Language of contract
These Terms are provided in English for informational purposes. The official binding version is the French version (CGU/CGV) available at /cgu-cgv. In case of discrepancy, the French version shall prevail.
